Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Exit Ticket ("we", "us", "our", or "Exit Ticket"), a New Zealand-based education technology platform. By accessing or using the Exit Ticket platform, website, and related services (collectively, the "Service"), you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a school, educational institution, or other organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" will refer to that organisation.
If you do not agree with any part of these Terms, you must not access or use the Service.
2. Description of Service
Exit Ticket is an AI-powered mathematics assessment platform designed for the New Zealand Curriculum. The Service enables teachers to create curriculum-aligned assessments, use AI-assisted marking, generate personalised learning plans for students, and access analytics to inform teaching practice. The Service is intended for use by teachers, school administrators, and students in New Zealand schools, primarily covering Years 4 through 10.
3. Eligibility and Account Registration
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Teacher and School Administrator Accounts: Teachers and school administrators must be employed by or affiliated with a New Zealand educational institution. By registering, you confirm that you have the authority to use the Service in connection with your professional role.
Student Accounts: Student accounts are created by teachers or school administrators. Each student account requires a valid email address. Teachers are responsible for ensuring that appropriate consent has been obtained from parents or guardians before creating student accounts, in accordance with the Privacy Act 2020 and their school's privacy policies. Students under the age of 16 should have parental or guardian consent before their information is entered into the Service.
4. Subscriptions, Free Trials, and Payment
Exit Ticket offers subscription-based access to the Service. Pricing details, including per-class rates and school-wide licence discounts, are displayed during the sign-up process and on the pricing section of our website.
Free Trial: New individual teacher accounts may be eligible for a 14-day free trial. To start the trial, you will be required to provide valid payment details. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin automatically and you will be charged at the applicable rate. Schools on invoice billing arrangements are not required to provide a credit card to start a trial.
Billing: Subscriptions are billed either monthly or annually, depending on the plan you select. All prices are in New Zealand Dollars (NZD) and are inclusive of GST where applicable. Payments are processed securely through our third-party payment provider, Stripe.
Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your access will continue until the end of your current billing period. After that, your classes will be deactivated but your account data will be retained for a reasonable period in case you choose to resubscribe.
Refunds: Refund requests are assessed on a case-by-case basis in accordance with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. If the Service fails to meet the guarantees set out in those Acts, you may be entitled to a remedy including a refund. To request a refund, please contact us at [email protected].
5. Acceptable Use
You agree to use the Service only for its intended educational purpose and in compliance with all applicable New Zealand laws. You must not:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use automated tools (bots, scrapers, etc.) to access the Service without our prior written consent.
- Upload or transmit any content that is offensive, defamatory, or infringes the rights of any third party.
- Share your account credentials with others or allow others to access the Service through your account.
- Use the Service in a way that could damage, disable, or impair the Service or interfere with other users' access.
6. Intellectual Property
All intellectual property rights in the Service, including but not limited to the software, design, text, graphics, logos, and AI-generated content, are owned by or licensed to Exit Ticket. These Terms do not grant you any ownership rights in the Service.
Your Content: You retain ownership of any content you upload to the Service, such as custom assessment questions or class data. By uploading content, you grant Exit Ticket a non-exclusive, royalty-free licence to use, store, and process that content solely for the purpose of providing and improving the Service.
AI-Generated Content: Questions, feedback, and other content generated by the AI features of the Service are provided for your use within the platform. You may use AI-generated questions and feedback in your teaching practice. However, Exit Ticket does not guarantee the accuracy of AI-generated content, and teachers are responsible for reviewing and moderating AI outputs before use with students.
Curriculum References: The Service references strand names, sub-strand names, and practice statements from the New Zealand Curriculum, which are published by the New Zealand Ministry of Education. These references are used for educational alignment purposes. The Service also provides links to third-party educational resources (such as Khan Academy, IXL, Maths Buddy, and Mathletics) as supplementary practice materials. Exit Ticket is not affiliated with these third-party providers and does not control their content.
7. AI-Assisted Features and Limitations
The Service uses artificial intelligence to generate assessment questions, mark student responses, and provide feedback. While we strive for accuracy, AI-generated outputs may contain errors. The AI system learns and improves from teacher moderation and feedback over time.
Teacher Oversight: Teachers retain full control over all AI-generated content. Teachers can review, edit, override, or reject any AI-generated question, mark, or feedback. AI marking is intended to assist teachers, not replace professional judgement.
No Guarantee of Accuracy: Exit Ticket does not warrant that AI-generated content will be error-free, complete, or suitable for any particular purpose. Teachers should review AI outputs before relying on them for assessment or reporting purposes.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information in accordance with the Privacy Act 2020. By using the Service, you consent to the practices described in the Privacy Policy.
Teachers and school administrators are responsible for ensuring that they have obtained appropriate consent from parents or guardians before entering student personal information into the Service, in accordance with their school's privacy obligations.
9. Service Availability and Modifications
We aim to provide reliable and continuous access to the Service. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to scheduled maintenance, system updates, or circumstances beyond our reasonable control.
We reserve the right to modify, update, or discontinue any feature of the Service at any time. Where changes materially affect your use of the Service, we will provide reasonable notice via email or through the platform.
10. Limitation of Liability
To the maximum extent permitted by New Zealand law, including the Consumer Guarantees Act 1993:
- The Service is provided "as is" and "as available" without warranties of any kind, except as expressly set out in these Terms or as required by law.
- Exit Ticket shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability to you for any claim arising from or related to the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits any rights you may have under the Consumer Guarantees Act 1993 or any other New Zealand legislation that cannot be lawfully excluded.
11. Indemnification
You agree to indemnify and hold harmless Exit Ticket, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law or the rights of any third party.
12. Termination and Suspension
We may suspend or terminate your access to the Service at any time if we reasonably believe you have breached these Terms, or if required to do so by law. We will endeavour to provide you with reasonable notice before termination, except where immediate action is necessary to protect the Service or other users.
Upon termination, your right to use the Service will cease immediately. We will retain your data for a reasonable period in accordance with our Privacy Policy and applicable law, after which it will be securely deleted.
13. Dispute Resolution
These Terms are governed by the laws of New Zealand. Any dispute arising from or in connection with these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to mediation in accordance with the Arbitration Act 1996 (as applicable to mediation) or commence proceedings in the courts of New Zealand.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you by email or through a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes.
15. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Exit Ticket regarding the Service and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
